MINUTES OF THE BOARD OF LICENSE COMMISSIONERS
OF CECIL COUNTY
The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Wednesday, February 23, 2011 at 9:15 A.M.

TRANSFER - Application received from Jennifer B. Wiesnegger, Bayard House Restaurant, LLC, T/A Bayard House Restaurant, 11 Bohemia Avenue, Chesapeake City, MD 21915 for transfer of Class "B " Beer, Wine & Liquor Alcoholic Beverage License No. B-21 from Helena duPont Wright, President; Caroline duPont Prickett, Vice President; Virginia duPont Suarez, Secretary/Treasurer, Bayard House Restaurant, Inc., T/A Bayard House, 11 Bohemia Avenue, Chesapeake City, MD 21915
Jennifer Wiesnegger appeared before the Board, as well as attorney Dwight Thomey on behalf of the current licensees. Mrs. Wiesnegger was duly sworn by the Clerk. The fully executed application packet with proper fees included: signatures of 10 registered voters and property owners in District 2-1; Alcohol Awareness Training; Certification Form; Worker's Compensation and a copy of the zoning certificate stating the premises is zoned for an alcoholic beverage license. Mr. Wilson read the public notice and stated it was duly advertised on February 10 and 16, 2011 in the Cecil Whig; he asked the applicant several questions from the application. Mr. Thomey stated his clients would like to ensure the transfer is conditioned upon settlement of the property, which should occur over the next week; the Board assured him this is their policy. Ms. Coyle stated the transfer would need to be conditioned upon settlement, receiving the Bulk Transfer Permit for the alcohol and the Board, if they choose approve the transfer and renew with the payment of the renewal fees. With no further discussion, Commissioner Curry made a motion to approve the transfer conditioned upon settlement, receiving the Bulk Transfer Permit, as well as approve the renewal with the proper fees being paid; Commissioners Gerweck seconded that motion and the Board then voted unanimously to approve the transfer with the conditions Commissioner Curry stated in the motion.

B-142 Paul Trapani, The Boat Warehouse, Inc., T/A Sunset Cafe, 111 River Road, Chesapeake City, MD 21915
Paul Trapani appeared before the Board to update them on the above-mentioned alcoholic beverage license. He stated next week they are supposed to be connected to the sewage and the Health Department is tentatively coming for their final inspection on March 10. He requested an extension until the end of April; Commissioner Gerweck made a motion to approve an extension through the end of April with no renewal late fees being due; Commissioners Curry seconded that motion and the Board then voted unanimously to approve the extension.
B-55 Patrick Evans, Jr., Evans Family Enterprises, Inc., T/A Big Elk Liquors & Deli, 105 Big Elk Mall, Elkton, MD 21921
Patrick Evans appeared before the Board; he stated there is a tentative purchase agreement, his attorney has sent this to the licensees' attorney, Bob Jones. He requested a 60-day extension; Commissioner Gerweck made a motion to approve an extension through the end of April, the license will need to be renewed prior to this time; Commissioners Curry seconded that motion and the Board then voted unanimously to approve the extension.
