MINUTES OF THE BOARD OF LICENSE COMMISSIONERS
OF CECIL COUNTY

 

The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Wednesday October 28, 2009 at 9:00 A.M.

PRESENT:
        Tim Snelling, Chairman

Request for additional space - Youn Shik Kim; Heidi J. Bazar; Fine Liquor, Inc. T/A Conowingo Discount Liquors, 303 Conowingo Road, Conowingo, MD 21918

 

Youn Shik Kim and Howard Killian appeared before the Board; Mr. Kim was duly sworn by the Clerk.  Mr. Killian spoke on Mr. Kim's behalf; he stated Mr. Kim would like to add 1200' – 1300' to the liquor store as the grocery business is not doing well.  He explained there will be two separate cashiers, it is more of a demolition of a wall and shelving will act as the wall, the only access to either store will be in the front of the building where there are three entrances.  Mr. Snelling asked if he needed to get a permit for the work, they stated yes.  Mr. Gerweck made a motion to approve the request for additional space with the proper permits; Mr. Curry seconded that motion and the Board then voted unanimously to approve the request for additional space.

 

Update – License Not Issued - John C. Hahn, Jr., Owner; Christopher C. Hahn, Owner; Hahn Investments, LLC; T/A Hahn's, 145 East Main Street, Cecilton, MD 21913

 

Chief Bradford stated he spoke with Mr. Hahn and settlement for the property has not occurred, as there is an issue with the property line as well as getting financing for the purchase.  Mr. Hahn will know by next week if he is approved for financing and has requested an extension.  Mr. Gerweck made a motion to approve the request for 30-day extension; Mr. Curry seconded that motion and the Board then voted unanimously to approve the request for the 30-day extension.

 

Update – License Not Issued - Rita S. Patel, President; Richard Anthony Shelby, Resident Agent; Shree Sai Liquors Inc., T/A Elk Landing Beer, Wine & Spirits, 218 West Pulaski Highway, Elkton, MD 21921

 

Attorney Jason Allison appeared before the Board; he stated his clients are scheduled for settlement on Monday, November 2, 2009 and are requesting an additional 30-day extension.  Mr. Gerweck made a motion to approve the request for 30-day extension; Mr. Curry seconded that motion and the Board then voted unanimously to approve the request for the 30-day extension.

 

Update – Expansion - Lance Grayson Mitchell Rowe, Member; Hook, Line & Sinkers LLC T/A Pickled Herring, 10 South Main Street, North East, MD 21901

 

Karl Fockler appeared to update the Board on the expansion project; he submitted pictures for the file.  He requested an additional 30-day extension to complete the projects which includes moving the gate; Mr. Gerweck made a motion to approve the request for 30-day extension; Mr. Curry seconded that motion and the Board then voted unanimously to approve the request for the 30-day extension.

 

Update - William Riddle, Member; Daru, LLC, T/A East Coast Liquors, 5279 Pulaski Highway, Perryville, MD 21903

 

William Riddle appeared to update the Board on the proposed improvement projects as required; he stated the Town of Perryville has approved the extension for the landscaping through October 31, 2010; he will submit the email/letters when he receives them. 

 

Question - J. Lee Younce, Jr., Member, Lee LLC, (Owner); 400 N. Bridge Street, Elkton, MD 21921

 

Phil Mudge appeared before the Board; he asked what is needed to obtain the Sunday Sales license; according to Article 2B Section 1-102 (22)(i)1. Restaurant is defined as "an establishment A. which accommodates the public. B. Which is equipped with a dining room with facilities for preparing and serving regular meals; and C. In which the average daily receipts from the sale of foods exceed the average daily receipts from the sale of alcoholic beverages," which in Cecil County is 25% food.  The Board stated that as long as they have a kitchen that is approved by the Cecil County Health Department they would consider this to fit this definition.  Mr. Mudge stated he is working on his application for transfer of the license.

 

Special Request - Natalie A. Horton, T/A Joe's Grog House, 26 South Main Street, Port Deposit, MD 21904

 

Natalie Horton appeared before the Board to request permission to stay open until midnight on November 29, 2009 when the Baltimore Ravens play the Pittsburgh Steelers, game begins at 8:20 PM.  The Board stated they cannot supersede state law, however as long as they do not allow sales or consumption of alcoholic beverages after 11:00 PM and are serving food they do not see why they could not stay open to accommodate their patrons.
