MINUTES OF THE BOARD OF LICENSE COMMISSIONERS

OF CECIL COUNTY

 

The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Tuesday, November 25, 2008 at 9:00 A.M.

 

PRESENT:     Tim Snelling, Chairman

                   Herrell 'Cuz' Curry, Commissioners

                   William Gerweck, Commissioner

                             H. Norman Wilson, Jr., Esquire

                   Earl R. Bradford, Chief Alcohol Beverage Inspector

                             Robin S. Coyle, Administrative Assistant

 

New License - Application received from Helen Widdoes, Member; Elk Lanes 11th Frame LLC, T/A Elk Lanes, 406 Bow Street, Elkton, Maryland 21921 for issuance of a new Class "B" Beer, Wine & Liquor Alcoholic Beverage License

 

Janet Elaine Shelton appeared before the Board; she stated Helen Widdoes has been hospitalized and is unable to attend.  There was a discussion with the Board attorney, H. Norman Wilson about Mrs. Shelton testifying for Mrs. Widdoes; Mrs. Shelton will be sworn and testify that Mrs. Widdoes' answers are true to her knowledge.  Ms. Coyle stated she met with Mrs. Widdoes when she was completing the application and can attest that she answered them and to the best of her knowledge they are true and correct.  Mrs. Shelton was duly sworn by the Clerk.  Mr. Wilson read the public notice which appeared on dates of November 12 and November 18.  The fully executed application packet with proper fees included: Zoning Certificate signed by Craig Trostle, Director, Building and Zoning, Town of Elkton; signatures of 10 registered voters and property owners in District 3-2 Alcohol Awareness Training; Certification Form stating the nature of the business will be an upscale package good store; Validation for Sunday Sales requesting off-premise sales only; Worker's Compensation to be submitted at a later date.  Mr. Snelling asked what the hours of operation will be and where the alcohol will be sold; Mrs. Shelton stated alcohol sales will be in the evening and Sundays only and the alcohol will be sold behind the snack bar or in one of the extra rooms.  With no further questions from the Board, Mr. Gerweck made a motion to approve the issuance of the alcoholic beverage license; Mr. Curry seconded that motion and the Board then voted unanimously to approve the issuance of the license. 

 

New Legislation Request - Kevin Atticks, Maryland Wine Association

 

Kevin Atticks appeared before the Board to present a new legislative request for a Class "W" Winery license; he passed out information regarding this and explained he is going to each county to present this. 

 

Update - Not Opened - Not issued - Paid - Class "B" BWL Alcoholic Beverage License No. B-121 - James William Kuhn and Elizabeth Rose Kuhn; Bainbridge Grill, Inc. T/A Bainbridge Grill, 1195 Tome Highway, Port Deposit, Maryland 21904

 

Elizabeth Kuhn and attorney Bob Jones appeared the Board; Mrs. Kuhn stated they have run into a few problems but hope to have their final inspections within the next few weeks and have a slow opening before Christmas.

 

Show Cause - No Resident Agent -        Class "B" BWL Alcoholic Beverage License No. B-130 - Cathy W. Parson; Vasudev Patel, Member; Nilesh Patel, Member; Swami Shree, LLC; T/A Hawthorn Suites, 304 Belle Hill Road, Elkton, Maryland 21921

 

Chief Bradford stated the licensees have turned in the license.

 

Update - Not Opened - Not issued - Class "B" BWL Alcoholic Beverage License No. B-97 - Karen Goncalves, T/A Golden Elk, 801 East Pulaski Highway, Elkton, MD 21921

 

Ms. Goncalves appeared before the Board for an update; she stated they have run into a few problems as the kitchen has not been a functioning kitchen for two years.  She continued that they are waiting on the binder number from their worker's compensation company.  She requested a 60-day extension; Mr. Gerweck made a motion to approve the 60-day extension; Mr. Curry seconded that motion and the Board voted unanimously to approve the 60-day extension.

 

Update - Not Opened - Not issued - Not Paid - Class "A" BWL Alcoholic Beverage License No. A-35 - Pamela Geracimos, Member; P&D Investments, LLC, T/A Village Beer, Wine & Spirits, Alexandra's Village, 701 Pulaski Highway, Elkton, MD 21921

 

Pam Geracimos appeared before the Board for an update; she stated they are moving along with the construction of the building and their plan is to be open by mid-February.  She submitted a check for the license.  Mr. Gerweck made a motion to approve an extension until March 1st; Mr. Curry seconded that motion and the Board voted unanimously to approve the extension through March 1st.

·                     B-62 - CM Tugs - Letter of reconsideration - the Board reviewed the letter submitted by CM Tugs - Mr. Curry made a motion to reconsider the fine and enforce the proceedings fee to be paid within 10 days with one-year probation if any additional violations resulting in a finding of guilty occur during that probationary period, the Board will reinstate the guilty verdict and the $250 fine, plus any additional fines and fees associated with that violation.
