MINUTES OF THE BOARD OF LICENSE COMMISSIONERS
OF CECIL COUNTY
The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 107 North Street, Elkton, MD on Tuesday, February 27, 2007 at 9:00 A.M.

Chairman Snelling called the meeting to order at 9:15 AM.
Rules and Regulations - Proposed changes
The Public Notice appeared on February 12, 2007. The amendments to the Rules and Regulations were discussed; Mr. Gerweck made a motion to accept the amendments and adopt the Rules and Regulations as presented, Mr. Curry seconded the motion and Mr. Snelling made it unanimous. Copies will be sent to the licensees with the 2007 Alcoholic Beverage Licenses.
New License Application - Application received from Christina Shelby, Member; Bizzy B, Inc., T/A Excellent Convenience Store, 1486 Perryville, MD 21903 for a new Class "B" Beer, Wine & Liquor (BWL) Alcoholic Beverage License
Christina Shelby with Sanjiv Sharma and attorney, Jason Allison, appeared before the Board; Mr. Wilson read the Public Notice which appeared on dates of February 13 and February 20, 2007. The fully executed application packet with proper fees included: Signature of more than 10 property owners and registered voters; Articles of Amendment with State of MD acceptance; Alcohol Awareness Training Certification form stating will take first available class; Certification Form stating the nature of business is a convenience store; Worker's Compensation verification will supply at later date; Waiver for Records Review. Mr. Wilson stated the application was accepted without the proper zoning certificate. Mr. Allison stated they are required to go before the Town of Perryville for an appeal of the decision that was made on the zoning; he requested a 60-day extension to get the required zoning certificate; Mr. Curry made a motion for a 60-day extension, Mr. Gerweck seconded that motion and Mr. Snelling made it unanimous.
Transfer License Application - Application received from Youn Shik Kim; Heidi J. Bazar; Fine Liquor, Inc., T/A Conowingo Discount Liquors, 311 Conowingo Road, Conowingo, MD 21918 for transfer of Class "A" Beer, Wine & Liquor (BWL) Alcoholic Beverage License A-27 from Doo Hwan Killian, T/A Conowingo Discount Liquors, 303 Conowingo Road, Conowingo, MD 21918 (A-27)
Youn Shik Kim and Heidi Bazar appeared before the Board; Mr. Wilson read the Public Notice which appeared on dates of February 13 and February 20, 2007. The fully executed application packet with proper fees included: Zoning Certificate signed by Eric Sennstrom, Director of Cecil County Planning & Zoning; Signatures of six property owners and registered voters; Articles of Incorporation with State of MD acceptance; Fingerprint cards; list of all members of the LLC; Pro Forma Financial Statement; Lease Agreement; Affidavit of Transferor; Alcohol Awareness Form; Certification form; Request for Sunday Sales; Workman's Compensation form. The applicants were duly sworn by the clerk; Mr. Wilson posed questions to the applicants as set forth in the alcoholic beverage license application. There was a discussion regarding the size of the business as the licensee plans to take the temporary wall down and expand the alcoholic beverage area and decrease the grocery area. Mr. Kim stated the store area is approximately 6,000 square feet. Chief Bradford stated the space needs to be less than 10,000 square feet. With no further questions or discussion Mr. Gerweck made a motion to approve the transfer conditioned upon submitting the sales contract with settlement sheet and the bulk sales permit; Mr. Curry seconded the motion and Mr. Snelling made it unanimous.

Ed Zebley appeared before the Board; he requested permission to be able to sell alcoholic beverages from the former ice cream store building. He stated they are trying to sell off two acres on the corner of the lot; the former building is cleaned up from the fire and the trailers are coming down; they would like to be able to be open to meet the 30 continuous day requirement and if things work out they would continue. He stated their ultimate goal would be to build a building for a pizzeria. There was a discussion that they would need to be open by August 1 to meet the 30 day requirement as the license will die on September 3, 2007. Mr. Gerweck stated he has no problem with it as long as they get the proper requirements from the other county offices and the Health Department; they will need to come back in before they open and renew the license in March.

Chief Bradford stated he and Chairman Snelling traveled to Annapolis to meet with the Legislatures regarding several of the items submitted and will return on March 13.

Frank Shaulis advised the Board the business was sold and settlement has occurred; anyone having to do with the licenses will appear before the Board in March.

Chief Bradford stated Perryville Investment Group is still in bankruptcy; it is unclear how they will renew the license without a lease.

We received a check from Will Riddle's office regarding the transcript from the North East Liquors appeal.
New Business
· Application for Crow's Nest - scheduled for March
