Worksession Minutes
October 5, 2010

PRESENT: Commissioners Lockhart, Demmler, Mullin, Tome (arrived at 9:15 a.m.), and Hodge; County Administrator Al Wein, Public Works Director Scott Flanigan and staff; Planning and Zoning Director Eric Sennstrom: Economic Development Director Vernon Thompson; Parks and Recreation Director Clyde Van Dyke; Budget Manager Craig Whiteford; Executive Office Administrator Vicky Rinkerman; County Counsel Norman Wilson, Chesapeake City Town Administrator Sharon Weygand; members of the press, and members of the public.

Evening agenda review

Action Items:

County Administrator Wein stated that the Board will consider appointments to the Cecil Partnerships Board and a settlement agreement with BPDI.

Director Sennstrom stated that the Board will consider the Amendments to the Master and Water Sewer Plan. He stated that the Board was considering revising the Master Water and Sewer Plan Amendment for the Town of Chesapeake City to include extending the line to the fire company and emergency services building on an adjacent property.

Sharon Weygand, Chesapeake City Town Administrator, stated that the Town has worked with MDE officials relative to the original language in the Master Water and Sewer Amendment to extend service to the Bohemia Manor school complex. Attempting to revise the language to extend the line to the adjacent property may jeopardize the loan application for the original project.

Public Works Option Contracts – Director Flanigan stated that the Board will consider the contracts relative to replacement of the Ragan Road Bridge and bid awards for Knights Corner Road and road salt.

Bid Award – Director Van Dyke stated that the Board will consider a bid award for the Chesland Park Stormwater Pond.

RFP – County Administrator Wein stated that the Board will consider RFP # 11-09 for the design, purchase and installation of fuel storage tank at the Courthouse.

Emergency Procurement – Budget Manager Whiteford stated that the Board will consider an emergency procurement to waive the bidding procedures relative to the UST tank removal at the Detention Center. He reviewed the budget amendments for consideration by the Board.

Introductory Items:

Assignment of Recovery Zone Facility Bond Allocation - Director Thompson stated that the Economic Development Department is recommending transferring the Recovery Zone Facility Bond Allocation to the State relative to securing a prospective business partner for Cecil County. The Board would consider action on the Resolution at the October 19, 2010 meeting.

Approval of the 2011 Holiday Schedule

County Administrator Wein reviewed the proposed 2011 Holiday Schedule.

Motion made by Commissioner Tome, second by Commissioner Mullin, the Board unanimously approved the 2011 Holiday Schedule as presented.

Sewage Sludge Utilization Permit – County Administrator Wein stated that the sewage sludge permit would be regulated by the Maryland Department of the Environment (MDE).

Director Sennstrom stated the Board has the option to request MDE conduct a public hearing to notify the public. MDE will advertise and conduct the public hearing.

Motion made by Commissioner Demmler, second by Commissioner Mullin, the Board unanimously agreed to request MDE conduct a public hearing for the sewage sludge utilization permit.

Commissioner Hodge requested that the County Department of Planning and Zoning mail a notice of the meeting to the adjoining property owners.

Farm Museum Mitigation Plan – Development Services Chief Tim Whittie stated that a resolution was negotiated with the Corp of Engineers regarding the wetland mitigation plan for the Farm Museum property. He stated that he advised Farm Museum officials that this project must stay on schedule. The Farm Museum is responsible for all work performed on the site.

Request to Fill – Director Nichols presented the request to fill several budgeted positions, one position in Housing, one paramedic position in Emergency Services, and one crew leader position in the Roads Department.

The Board concurred to authorize the Human Resources Department to advertise and fill the positions as requested.

Commissioner Comments

Commissioner Hodge stated that he feels the County should have been better prepared to respond to the flooding issues regarding the location of signs for flooding roads and responding to the emergency in a timely manner.

Commissioner Mullin stated Rupert Rossetti has requested permission to appoint Moria Croghan from the Sassafras River Association as his alternative to attend the stormwater ordinance committee meetings in his absence. Mr. Whittie stated that he has no objections to the appointment.

The Board concurred to appoint Moria Croghan to the committee as an alternate member for Mr. Rossetti.

Televised Commissioner Meetings – Director Mesneak stated that he was asked to investigate broadcasting County Commissioner meetings. He contacted Queen Anne's County and Harford County regarding their procedure for broadcasting Board meetings. Queen Anne's County has a studio and broadcasting station. The county would need to invest in establishing a broadcast station and meet FCC regulations, which requires operating the station twelve hours per day.

Commissioner Hodge reminded everyone that an audio recording is available on our website for the meetings held in the County Administration Building.

Director Mesneak stated that the other counties report approximately a 4% viewing audience. In response to a question from Commissioner Hodge, he stated that the County could begin tracking the number of people who visit the website and listen to the audio recording of the meetings.

The Board concurred to take no action at this time to broadcast the Commissioner meetings; however, the IT Department will continue to investigate alternatives to provide this service to the public.

9:45 AM – Being no further business and no closed session scheduled, on motion by Commissioner Demmler, second by Commissioner Lockhart , the Board adjourned the meeting.
