MINUTES OF THE BOARD OF COUNTY
COMMISSIONERS MEETING
December 7, 2010
The Board of County Commissioners for Cecil County met in regular session at the County Administration Building, 200 Chesapeake Blvd., Elkton, MD. The following members of the Board were present:
- Brian L. Lockhart, President
- Rebecca J. Demmler, Vice President
- Wayne L. Tome, Commissioner
- Robert J. Hodge, Commissioner
- James T. Mullin, Commissioner
Constituting a full Board.
The meeting of the Board of County Commissioners for Cecil County, December 7, 2010 was called to order by Commissioner Lockhart at 7:00 p.m. and opened with the Pledge of Allegiance.

Motion to approve the minutes was made by Commissioner Demmler and seconded by Commissioner Tome and unanimously carried to approve.
- COMMISSIONER COMMENTS-
Commissioner Mullin wished everyone a happy holiday.
Commissioner Hodge commented he was thankful to serve with Commissioner Lockhart, Commissioner Demmler and Commissioner Tome and feels they have accomplished many things.
Commissioner Tome commented it was a bittersweet day and that he was very proud of the accomplishments they have achieved. Commissioner Tome also commented he hoped the new Board would keep in mind they are here to serve the public and provide a good quality of life to the citizens of Cecil County.
Commissioner Demmler expressed her gratitude to serve Cecil County and feels a great sense of pride for all the work they have accomplished.
Commissioner Lockhart commented he was thankful for the four years he served and he will continue to attend all the worksessions and public hearings his schedule will allow.
- INTRODUCTORY ITEMS-
- QUITCLAIM DEED; Between Pettinaro Enterprises(Grantor) and The Board of County Commissioners of Cecil County(Grantee) for Lots 1-6 and Lots 15-31 as shown on the plat entitled "Winding Brook, Plat Twelve, filed among the Plat Records of Cecil County in WAS 4/76" and Lots 34-43, Block H, Plat 3, filed among the Plat Records of Cecil County in RRC 1/118
Alfed C. Wein, Jr., County Administrator presented a Quitclaim Deed between Pettinaro Enterprises and the Board of County Commissioners of Cecil County. Seventeen town home lots and 10 single family lots will be donated to the County Commissioners by Pettinaro Enterprises.
- COMMISSIONER COMMENTS-
Commissioner Hodge asked if they were any public purpose for the Commissioners to take title to these lots.
County Administrator responded the property is adjacent to the Fletchwood Community Park and the lots are developable land that could be added to the existing Community Park.
The decision on this matter will be placed on the Board's agenda for December 21, 2010 meeting.
- ACTION ITEM-
- License Agreement; Agreement between Union Hospital of Cecil County and Board of County Commissioners of Cecil County for the purpose of constructing pedestrian shelter structures at two locations on County property in Elkton, Maryland
Alfred C. Wein, Jr., County Administrator presented a lease agreement between Union Hospital of Cecil County and the Board of County Commissioners of Cecil County. Union Hospital of Cecil County (Licensor) and the Board of County Commissioners of Cecil County (LICENSEE) would like to enter into an agreement for the purpose of constructing pedestrian shelters for the convenience of the citizens using the licensee's transportation services at two locations on the on the licensor's property in Elkton, MD.
Motion to approve the lease agreement was made by Commissioner Demmler and seconded by Commissioner Tome and unanimously carried to approve. A copy of the lease agreement is attached and incorporated into these minutes.
- Rezoning Decision File No. 2010-05 - Applicant: Edward D.E. & Holly Rollins, III. Property Location: 172 Muller Thym Farm Lane, Perryville, MD 21903. Election District: 5, Tax Map: 35, Parcel: 467. Present land use designation: RCA-Non Buffer Modification Area. Request: Request change in land use designation to RCA-Buffer Modification Area in the critical area. Property Owner: Edward D.E. and Holly Rollins, III, Eric Sennstrom, Director of Planning and Zoning.
Eric Sennstrom, Director of Planning and Zoning presented the rezoning application for applicant Edward D.E. and Holly Rollins, to request change in land use designation to RCA-Buffer Modification Area in the critical area.
Motion to approve the land use designation request based on the applicant meeting the requirements of Cecil County Zoning Ordinance Section 203.3 b and based on the fact no disturbance of vegetation or trees would be required, was made by Commissioner Mullin, seconded by Commissioner Tome and unanimously carried to approve.
- APPOINTMENTS-
Alfred C. Wein Jr., presented the following appointments to the Board for their consideration.
Cecil County Mental Health Core Service Agency Advisory Committee
o New Appointment of Kevin Lunden, term date of 12/7/2010 – 12/7/2013
o New Appointment of Heidi Scheppelmann, term date of 12/7/2010 – 12/7/2013
Motion to approve the following appointments was made by Commissioner Demmler and seconded by Commissioner Mullin and unanimously carried to approve.
Cecil Partnerships for Children Youth & Families
o Reappointment of Denise Davis, term date of 10/1/2010 – 10/1/2012
o Reappointment of Vince Wernz, term date of 10/1/2010 – 10/1/2012
Motion to approve the following appointments was made by Commissioner Tome, seconded by Commissioner Demmler and unanimously carried to approve.
Bainbridge Development Corporation
o New Appointment of Michael Pugh, for date of 12/7/2010 – 12/7/2014
Motion to approve the following appointments was made by Commissioner Hodge, seconded by Commissioner Mullin and unanimously carried to approve.
Public Safety Pension Board of Trustees
o New Appointment Douglas Lamdin, for term date of 12/7/2010 – 06/30/2012
Motion to approve the appointment was made by Commissioner Hodge, seconded by Commissioner Demmler and unanimously carried to approve.
- DEPARTMENT OF PUBLIC WORKS-
- INTRODUCTION OF Resolution; TRUCK WEIGHT LIMITATIONS ON CERTAIN CECIL COUNTY ROADWAYS-
Director Flanigan introduced a resolution in accordance with the Annotated Code of Maryland Transportation Article, Section 24-204(a) (2) and Section 25-102(a) (11) that gives authority to restrict truck traffic of roads maintained by Cecil County.
The resolution will be placed on the Board's agenda for consideration at their December 21, 2010 meeting.
-BID NO. 11-20; VINYL SIDING RECYCLING-
Upon the recommendation of Director Flanigan, a motion was made to award Bid no. 11-20 to Arundel Recycling for their payment of $100.00 per ton by Commissioner Tome, seconded by Commissioner Hodge and unanimously carried to approve.
- BID NO. 11-21; CRUSH AND GRIND CONCRETE AND ASPHALT-
Upon the recommendation of Director Flanigan a motion was made to cancel Bid No. 11-20 was made by Commissioner Hodge, seconded by Commissioner Tome and unanimously carried to approve.
Director Flanigan thanked the Board for their support over the years.
- BUDGET AMENDMENTS NOS. 42-51
Alfred C. Wein, Jr., County Administrator, presented budget amendments 42-51 for consideration.
Motion to approve Budget Amendments No's 42-51 was made by Commissioner Tome, seconded by Commissioner Demmler and unanimously carried to approve. A copy of the Budget Amendments are attached and incorporated into these minutes.
Commissioner Hodge commented in the future when there is a request for an exception to the normal bidding process when it comes to purchasing that the Commissioners are aware of the conditions as to why the normal process is not being followed.
The next regular meeting of the Board of County Commissioners will be on December 21, 2010 at 7:00 p.m. at the County Administration Building, 200 Chesapeake Blvd., Elkton MD, 21921.
There being no further business of the County Commissioners, the meeting was adjourned.
