The Board of County Commissioners of Cecil County met for the purpose of a Rezoning Hearing at the County Administrative Building 107 North Street, Elkton, MD on Thursday, November 1, 2005 at 2:00 PM. The following members were present:
Nelson K. Bolender, President
Harry A. Hepbron, Vice President
Phyllis Kilby, Commissioner
William C. Manlove, Commissioner
Mark H. Guns, Commissioner
Constituting a full Board.
The meeting was called to order by President Bolender at 2:00 p.m. and opened with the Pledge of Allegiance.

File No. 2005-13 - Applicant: Harrol L. Mary J. Roberson, Property Location: 52 Ratledge Lane, Conowingo, MD. Election District: 7, Tax Map: 16, Parcel: 437. Presently Zoned: Open Space. Request: To rezone .807 Acre from Open Space to Rural Residential (RR). Property Owner: Harrol L. & Mary J. Roberson.
All witnesses presenting testimony were sworn by Al Wein, County Administrator.
Harrol L. Roberson and Jessie Dean appeared before the Board of County Commissioners pursuant to a request for rezoning Application 2005-13, based upon a mistake in the 1993 Comprehensive Rezoning.
Testimony was presented by Mr. Dean relative to zoning of the property prior to the 1993 Comprehensive Rezoning and the past and current uses of the property.
Mr. Roberson advised the Board that the property was deeded to him in 1982 and at that time, the property was zoned Rural Residential, he stated that he was unaware of the zoning change to the property.

Clifford Houston, Zoning Administrator for the Office of Planning, Zoning, Parks & Recreation advised the Board that the Planning Staff recommended approval of this request, due to a mistake in the 1993 Comprehensive Rezoning.
The Planning Commission recommended approval.
Mr. Clifford Houston, Zoning Administrator presented the Findings of Facts.
A motion was made by Commissioner Kilby to approve the rezoning request of Harrol L. and Mary J. Roberson, based upon a mistake in the 1993 Comprehensive Rezoning. The motion was seconded by Vice President Hepbron and carried unanimously to approval.
There being no further business, the meeting concluded.
