The Board of County Commissioners for Cecil County met in regular session at the County Administrative Building, 107 North Street, Elkton, Maryland on Tuesday, March 2, 2004.  The following members of the Board were present:

Nelson K. Bolender, President
Phyllis Kilby, Vice President
Harry A. Hepbron, Commissioner
William C. Manlove, Commissioner
Mark H. Guns, Commissioner

Constituting a full Board.

The meeting was called to order by President Bolender at 7:00 p.m. and opened with the Pledge of Allegiance.

The minutes from the February 17, 2004 meeting of the Board of County Commissioners were unanimously approved.

The minutes from the February 18, 2004 special meeting of the Board of County Commissioners in Perryville, concerning a Road Construction District, were unanimously approved.

-   PUBLIC HEARING –  AMENDMENT TO SUB-DIVISION REGULATIONS, RIGHT OF WAY –

Mr. Eric Sennstrom, Director, Planning, Zoning, Parks & Recreation presented to the Board for approval an amendment to the Sub-Division Regulations involving right of way widths and pavement requirements.  The Planning Commission recommended approval of said amendment on February 17, 2004 at a public hearing.

Discussion:

Commissioner Guns recommended additional language to the proposed amendment relating to the distance for relocation of improvements.

Motion was made by Vice President Kilby, to adopt with Commissioners Gun’s recommendation the amendment, seconded by Commissioner Guns and unanimously carried to approve the Amendment to Sub-Division Regulation, Article VII, Design Standards & Requirements, Section 7.2 – Highways, Streets & Roads.  A copy of this amendment is incorporated hereto and made part of these minutes.

-  COMMISSIONERS’ COMMENTS –

Commissioner Manlove – commented on the very low turn-out of voters in the primary election.

Commissioner Hepbron – declined comment.

Vice President Kilby - commented relative to the “Horse of the Year Award” named by the Maryland Breeder’s Association that was awarded to a horse owned by  Mrs. Dupont.  This is the third time a horse from Cecil County has won this honor.  Vice President Kilby stressed the importance of supporting the horse industry in Cecil County and throughout the State of Maryland.  Her concern is with the proposal on slots looming in the future that we must make sure the horse industry is not forgotten. In addition, Vice President Kilby commented on the presentation by Dr. Sara Taylor Rogers scheduled for later in the week and the Freedom Hills Dinner and Auction that she recently attended.

President Bolender – commented relating to his recent appearance in Annapolis to testify on a bill and the delay he encountered.

Commissioner Guns – spoke of the Legislative Breakfast he and the other Commissioners attended.  The Slots Proposal was discussed and Senator Jacobs would like the citizens of the county to contact her with their input.  He also encouraged citizens to attend the Cecil County Chamber Update Luncheon on March 9th at Patriot’s Glen.

-  PROCLAMATION - NATIONAL AGRICULTURE WEEK –

President Bolender presented on behalf of the County Commissioners a Proclamation to Mr. Ewing McDowell, the President of the Cecil County Farm Bureau and proclaimed the week of March 14 – 21 National Agriculture Week. 

- PRESENTATION OF FIRST CLASS BOY SCOUT CERTIFICATES –

Vance Fields – commented relative to an inquiry he had made last July in reference to a mineral extraction fee.   Mr. Fields also inquired regarding a recent Ethics Ruling and status of bids.

Motion was made by Commissioner Guns, seconded by Vice President Kilby and unanimously carried to appoint the following to the Board of Library Trustees for a five-year term to expire on March 2, 2009:

Upon the recommendation of Ms. Nichols, motion was made by Commissioner Hepbron, seconded by Vice President Kilby and unanimously carried to grant a Resolution to Revise the Cecil County Code Article XVII – Other Types of Leave.  This revision concerns Administrative Leave for an employee who serves as an election judge.

- CONTRACT AWARD, LAND PRESERVATION PARKS & RECREATION PLAN -

Mr. Ed Slicer, Manager, Parks & Recreation presented to the Board a recommendation for award of contract relating to Land Preservation for the Parks & Recreation Plan. Upon the recommendation of Mr. Sennstrom, Director, Planning, Zoning, Parks & Recreation, motion was made by Commissioner Hepbron, seconded by Vice President Kilby and unanimously carried, that the low bidder, Environmental Resources Management, Inc., be awarded the contract in the amount of $37, 495.00.

-  RECOMMMENDATION FOR AWARD – BID NO. 04-29,  PINE HILLS PUMP CONTROL SYSTEM –

Mr. Wein, County Administrator, presented the following recommendations for bid awards to the Board for approval:

Upon the recommendation of the Purchasing Agent and the Department of Public Works, motion was made by Vice President Kilby, seconded by Commissioner Manlove and unanimously carried to award Bid No. 04-29 to Best Electric in the amount of $15,550.00.

- RECOMMENDATION FOR AWARD – BID NO. 04-30, HONEYWELL FUSION DVR SERIES –

Upon the recommendation of the Purchasing Agent and the Department of Facilities Maintenance, motion was made by Vice President Kilby, seconded by Commissioner Guns and unanimously carried to award Bid No. 04-30 to Delta Alarm Systems, LLC, in the amount of $15,950.00.

-  RECOMMENDATION FOR AWARD – BID 04-31, HEWLETT PACKARD PRINTERS & EQUIPMENT –

Upon the recommendation of the Purchasing Agent, motion was made by Commissioner Hepbron, seconded by Commissioner Guns and unanimously carried to award the Bid No. 04-031 to PC Supplies in the amount of $18,932.

- BUDGET AMENDMENTS – NOS. 112 – 127

Upon the recommendation of Mr. Wein, motion was made by Commissioner Hepbron, seconded by Commissioner Manlove and unanimously carried to approve Budget Amendments Nos. 112 - 127

There being no further business of the County Commissioners, meeting adjourned.

The next meeting of the Board of County Commissioners will be held on Tuesday, March 16, 2004, 7:00 p.m., at the Town of Elkton, Town Hall, 100 Railroad Ave., Elkton, MD.
