MINUTES OF THE BOARD OF COUNTY COMMISSIONERS
May 23, 2001
The Board of County Commissioners of Cecil County met at the County Administration Building, 107 North Street, Elkton, Maryland, on Wednesday, May 23, 2001. The following members of the Board were present:

The meeting was called to order by President Bolender at 2:30 p.m. and opened with the Pledge of Allegiance.
- PUBLIC HEARING – ARGICULTURAL PRESERVATION DISTRICT -
Ms. Sandra Edwards, of the Office of Planning and Zoning, presented 23 applications for Agricultural Preservation District. She advised that both the Agricultural Advisory Board and the Planning Commission recommend approval of the applications, the applications are as follows:
APPLICANT: Terry R. and Jeane E. Addis FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 454 Cherry Grove Road, Earleville, MD, Tax Map: 51, Parcel: 61, Acreage: 58.894 acres, 1st Election District. PROPERTY OWNER: Terry R. and Jeane E. Addis. PRESENTLY ZONED: Southern Agricultural Residential (SAR).
Ms. Edwards advised that 70% of the soils fall into Classes 1-3. It adjoins two proposed Districts and the State of Maryland property.
APPLICANT: James L. and Julia D. Corder FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 300 Cherry Grove Road, Earleville, MD, Tax Map: 52, Parcel: 5, Acreage: 48.983 acres, 1st Election District. PROPERTY OWNER: James L. and Julia D. Corder. PRESENTLY ZONED: Rural Residential (SAR).
Ms. Edwards advised that 77% of the soils fall into Classes 1-3 and the woodlands Group 1 and 2. It adjoins a proposed District. There are currently beans, corn, barley, and wheat on the property.
APPLICANT: Phyllis B. Craig FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 404 Mill Lane, Earleville, MD, Tax Map 57, Parcel 83, Acreage: 116.4136 acres, 1st Election District. PROPERTY OWNER: Phyllis B. Craig. PRESENTLY ZONED: Southern Agricultural Residential (SAR).
Ms. Edwards advised that 100% of the soils are in Classes 1-3. It adjoins two easement properties and one District. Current use is for wheat and beans.
APPLICANT: Elizabeth O. Ward FOR: Establishing and Agricultural Preservation District. PROPERTY LOCATION: 680 Cherry Grove Road, Earleville, MD, Tax Map: 51, Parcel: Part of 3 (N/S Cherry Grove Road). Acreage: Approximately 278 acres, 1st Election District. PROPERTY OWNER: William C. and Elizabeth O. Ward. PRESENTLY ZONED: Southern Agricultural Residential (SAR).
Ms. Edwards advised that 76% of the soils are in Group 1-3 and woodlands Groups 1 and 2. It adjoins a proposed District.

Ms. Edwards advised that 68% of the soils are in Group 1-3 and woodlands Groups 1 and 2. It adjoins two other proposed properties.

Ms. Edwards advised that 70% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. It adjoins a proposed district. The majority of the property is wooded.
APPLICANT: Earl and Reda A. Carey, Jr. FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 225 Stemmers Run road, Earleville, MD, Tax Map: 56, Parcel: 39, Acreage: 92.2397 acres, 1st Election District. PROPERTY OWNER: Earl and Reda A. Carey, Jr. PRESENTLY ZONED: Southern Agricultural Residential (SAR).
Ms. Edwards advised that 52% of the soils are in Classes 1-3. It adjoins the federally owned Stemmers Run property, which is managed by the State.
APPLICANT: Eastern Shore Land Conservancy, Inc. FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 987 Sandy Bottom Road, Earleville, MD, Tax Map: 62, Parcel: Part of 2, Acreage: 80.4 acres, 1st Election District. PROPERTY OWNER: Eastern Shore Land Conservancy, Inc. PRESENTLY ZONED: Southern Agricultural Residential (SAR).
Ms. Edwards advised that 93% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. All four are withholding an acre for housing sites for the Amish.

FOR: Establishing an Agricultural Preservation District, PROPERTY LOCATION: 987 Sandy Bottom Road, Earleville, MD, Tax Map: 62, Parcel: Part of 2, Acreage: 65.2 acres, 1st Election District. Ms. Edwards advised that 95% of the soils are in Classes 1-3. It adjoins two other proposed Districts.

PROPERTY LOCATION: 987 Sandy Bottom Road, Earleville, MD, Tax Map: 62, Parcel: Part of 2, Acreage: 81.8 acres, 1st Election district. PROPERTY OWNER: Eastern Shore Land Conservancy, Inc. PRESENTLY ZONED: Southern Agricultural Residential (SAR) WITH 11.253 acres in the Critical Area, Resource Conservation Area (RCA)..
Ms. Edwards advised that 61% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. It adjoins two other proposed Districts.

Ms. Edwards advised that 93% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. It adjoins two other proposed Districts. There is currently corn, beans, and barley on all four properties.
APPLICANT: Robert and Winona Abbott FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 490 Cherry Grove Road, Earleville, MD, Tax Map: 52, Parcel: 467, Acreage: 20.00 acres, 1st Election District. PROPERTY OWNER: Robert and Winona Abbot. Ms. Edwards advised that 64% of the soils are Classes 1-3 and woodlands Groups 1 and 2. It adjoins two proposed Districts. Horses and crops are currently on the property.
APPLICANT: Mildred Ayers FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 560 Barnes Corner Road, Rising Sun, MD, Tax Map: 17, Parcel: 9, Acreage: 148.493 acres, 6th Election district. PROPERTY OWNER: F Ellis and Mildred Ayers. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards advised that 79% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. Currently, there is hay, beans, corn, and barley on the property. It adjoins another proposed District.
APPLICANT: Mildred Ayers FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 324 Barnes Corner Road, Rising Sun, MD, Tax Map: 17, Parcel: 91, Acreage: 40/967 acres, 6th Election district. PROPERTY OWNER: F Ellis and Mildred Ayers. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards advised that 86% of the soils are in Classes 1-3. They are withholding nine acres to convey to their son.

PROPERTY LOCATION: 1865 Liberty Grove Road, Colora, MD, Tax Map: 16, Parcel: 10, Acreage: 124.5 acres, 6th Election District. PROPERTY OWNER: Balderston Family Partnership. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards advised that 84% of the soils are in classes 1-3 and woodlands Groups 1 and 2. The current use is orchard. It adjoins another proposed District.

Ms. Edwards advised that 92% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. It adjoins three proposed Districts. The current use is orchard, corn, and beans.
APPLICANT: Shawn D. and John W. Madron FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 831 Nesbitt Road, Colora, MD, Tax Map: 9, Parcel: 124, Acreage: 20.919 acres, 6th Election District. PROPERTY OWNER: Shawn D. and John W. Madron. Ms. Edwards advised that 93% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. The owner is withholding two acres for a lot. The current use is corn and hay.
APPLICANT: Floyd Allred, Jr. FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 672 Nesbitt Road and 1028 Colora Road, Colora, MD, Tax Map: 9/10, Parcels: 120/249, Acreage: 174.59 acres, 6th Election District. PROPERTY OWNER: Floyd Allred, Jr. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards advised that 94% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. It adjoins two proposed Districts. Current use is for livestock and a grain operation. They are withholding two acres for a new house.
APPLICANT: Kilby’s Inc. FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 833 Firetower Road, Colora, MD, Tax Map: 17, Parcel: 24, Acreage: 40.97 acres, 6th Election District. PROPERTY OWNER: Kilby’s Inc., c/o John Kilby. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards advised that 94% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. Part of the dairy operation (3.5 acres) is being withheld for conveyance to daughter.
APPLICANT: Kilby’s Inc. FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 795 Firetower Road, Colora, MD, Tax Map: 17, Parcel: 13, Acreage: 263.00 acres, 6th Election District. PRESENT OWNER: Kilby’s, Inc., c/o John kilby. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards Advised that 90% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. It adjoins two proposed Districts.
APPLICANT: Oakwood Rod and Gun Club, Inc. FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: NW/S Oakwood Road, Conowingo, MD, Tax Map: 8, Parcel: 5, Acreage: 100.1324 acres, 8th Election District. PROPERTY OWNER: Oakwood Rod and Gun Club, Inc., c/o Donald McCullough. PRESENTLY ZONED: Northern Agricultural Residential (NAR)/
Ms. Edwards advised that 76% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. There is about one-half to one mile of MALPF easement property. The property is rented for a grain operation.
APLICANT: John and Diana Russell: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 135 Shelton Lane, Rising Sun, MD, Tax Map: 5, Parcels: 214 and 152, Acreage: 71.11 acres, 9th Election District. PROPERTY OWNER: John and Diana Russell. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards advised that 70% of the soils are in Classes 1-3 and woodlands Groups 1 and 2. There is currently an equine operation on the property, and they are withholding three acres.
APPLICANT: William G. and Lisa M. England FOR: Establishing an Agricultural Preservation District. PROPERTY LOCATION: 954 England Creamery Road, Rising Sun, MD, Tax Map: 11, Parcel: 369, Acreage: 36.642 acres, 9th Election District. PROPERTY OWNER: William G. and Lisa M. England. PRESENTLY ZONED: Northern Agricultural Residential (NAR).
Ms. Edwards advised that 70% of the soils are in Classes 1-3 and woodland Groups 1 and 2. The property is contiguous to two MALPF Districts, and the current use is pasture and woodland.
Motion was made by Commissioner Kilby, seconded by President Bolender, and unanimously carried to recommend to the Maryland Agricultural Land Preservation Foundation that all of the applications for Agricultural Preservation Districts be approved.
