MINUTES OF THE BOARD OF COUNTY

COMMISSIONERS MEETING

 

April 1, 2008

 

            The Board of County Commissioners for Cecil County met in regular session at the County Administrative Building, 200 Chesapeake Blvd., Elkton, MD.  The following members of the Board were present:

 

            William C. Manlove, President

            Mark H. Guns, Vice President

            Rebecca J. Demmler, Commissioner

            Brian Lockhart, Commissioner

            Wayne L. Tome, Sr., Commissioner

 

Constituting a majority Board.

 

            The Board adjourned into a closed session at its April 1, 2008 work session.  Motion was made by Commissioner Demmler, seconded by Commissioner Tome and unanimously carried to pursuant to the State Government, Annotated Code of Maryland 10-508 (a) (1) - Personnel matters.

           

            The meeting of the Board of County Commissioners for Cecil County, April 1, 2008 was called to order by Commissioner Manlove at 7:00 p.m. and opened with the Pledge of Allegiance.

           

            The minutes from the March 18, 2008 were unanimously approved.

 

            -COMMISSIONERS' COMMENTS-

 

Vice President Guns - commented about the current budget process.  He also commented about the decision by the Board delay the forms of government vote.

 

The remainder of the Board declined comment.

 

-          PROCLAMATION - PUBLIC HEALTH WEEK -

 

            The Board presented a proclamation to Stephanie Garrity, Health Officer, Cecil County Health Department in observance of National Public Health Week.

 

-          OUTSTANDING COMMUNITY SERVICE AWARDS IN PUBLIC HEALTH -

 

            Stephanie Garrity presented awards to Virginia Bailey, the Conowingo Lions Club and Vicky Rinkerman for their contribution in the area of public health.

 

-          PROCLAMATION - CHRISTMAS IN APRIL - NEIGHBOR HELPING NEIGHBOR REBUIDLING DAY -

 

            The Board presented a proclamation to Henry Burden, in honor of Christmas in April, Neighbor helping Neighbor, Rebuilding Day April 26, 2008.

 

-          PROCLAMATION - FAIR HOUSING MONTH -

 

            The Board presented Dave Mahaney, Director, of Community Housing & Development in honor of Fair Housing Month. 

 

-          PUBLIC HEARING - ENVIORNMENTAL HEALTH - PROPOSED FEES -

 

            Charles Smyser, Chief, Environmental Health Officer, presented a public hearing outlining the proposed increases in the fee schedule for the Cecil County Environmental Health Department's services.  The proposed increases, if approved, will be effective July 1, 2008.

 

This matter will be placed on the Board's agenda for their April 15, 2008 meeting as an action item.

 

-          PUBLIC COMMENT -

 

Dwight Thomey, Elkton - commented in support to the amendment to the Master Water & Sewer Plan relating to the Wilna Farm.

 

Charles Herzog, Colora - commented about the decision of the Board to delay the vote for the forms of government, and encouraged the Board to reconsider "Code Home Rule" as opposed to "Charter Government".

 

-          TEXT AMENDMENT, SUBDIVISION REGULATIONS - AMEND ARTICLE II, SECTION 3.4 PENALTIES -

 

            Eric Sennstrom, Director of Planning & Zoning, presented the Text Amendment to the Subdivision Regulations for consideration as presented to the Board during a public hearing at the March 18, 2008 Board of County Commissioners' meeting.

 

Motion was made by Vice President Guns to disapprove the Text Amendment and following the recommendation of the Planning Commission to revisit this amendment after further review.  The motion was seconded by Commissioner Lockhart and carried by a majority vote of 4-1.

-          TEXT AMENDMENT, 2004 MWSP - THE WILNA FARM -

 

            Director Sennstrom presented the Text Amendment to the 2004 Master Water & Sewer to include The Wilna Farm, Parcels 369 & 618 as a W3 service area and the Sewer Service Area map to include these parcels as a S3 service area, as presented during a public hearing at the Board of County Commissioners' meeting on March 18, 2008.

 

Vice President Guns asked for clarification of documentation from the Maryland Department of the Environment concerning compliance of request from that department with regard to this project.

 

Brian Morgan, Project Manager, KCI Technologies verified that he has made contact with MDE and this project is in active status, and all required testing will be conducted upon obtaining the amendment to the Master Water & Sewer Plan.  He further advised, that it his opinion, that it was not fiscally responsible to do the required MDE testing prior to obtaining amendment.

 

Commissioner Demmler made a motion to disapprove the amendment based upon the fact that this amendment is outside of the growth boundary and that the request is premature as it relates to the Elkton West Wastewater Treatment Plant. 

 

President Manlove seconded the request.

 

The motion was not carried.

Vice President Guns made a motion to approve the amendment, the motion was seconded by Commissioner Lockhart and carried by a majority vote.

-          DEPARTMENT OF PUBLIC WORKS -

 

            W. Scott Flanigan, Director of Public Works presented the following items for consideration:

 

 

-          BID AWARD NO. 08-32 - WORK TRUCK -

 

            Upon the recommendation of Mr. Flanigan, motion was made by Commissioner Lockhart, seconded by Commissioner Tome, and unanimously carried to award Bid No. 08-32 to Beltway International Trucks, Inc., in the amount of $63,389.

 

-          BID AWARD - RFP - 08-09 - PRE-CAST WALLS -

 

            Upon the recommendation of Mr. Flanigan, motion was made by Commissioner Lockhart, seconded by Commissioner Tome and unanimously carried to award Bid No. RFP 08-09, to Keystone Concrete Products, Inc., in the amount of $11,730.

 

-          BID NO. 08-11-55030 - PRINCIPIO SANITARY SEWER SUBDISTRICT SOUTH INTERCEPTOR -

 

            Upon the recommendation of Mr. Flanigan, motion was made by Vice President Guns, seconded by Commissioner Demmler and unanimously carried to table this bid pursuant to ongoing discussion with the Town of Charlestown relating to this project.

 

-          BUDGET AMENDMENT NOS.  80 -87 -

           

            Motion was made by Commissioner Demmler, seconded by Commissioner Tome, and unanimously carried to approve Budget Amendment Nos. 80-87. A copy of these budget amendments are attached hereto and made part of these minutes.

 

            The next regular meeting of the Board of County Commissioners will be held on April 15, 2008 at 7:00 p.m. at the North East Town Hall.

 

There being no further business of the County Commissioners, the meeting concluded.
