MINUTES OF THE BOARD OF COUNTY

COMMISSIONERS MEETING

 

March 4, 2008

 

            The Board of County Commissioners for Cecil County met in regular session at the County Administrative Building, 200 Chesapeake Blvd., Elkton, MD.  The following members of the Board were present:

 

            William C. Manlove, President

            Mark H. Guns, Vice President

            Rebecca J. Demmler, Commissioner

            Brian Lockhart, Commissioner

            Wayne L. Tome, Sr., Commissioner

 

Constituting a majority Board.

 

            The Board adjourned into a closed session at its February 26, 2008 work session.  Motion was made by Commissioner Lockhart, seconded by Vice President Guns and unanimously carried to discuss "consideration of acquisition of real property for a public purpose", and personnel matters that affects one or more individuals, pursuant to the State Annotated Code of Maryland 10-508 (a) (1) & (3).

           

            The Board adjourned into a closed session at its March 4, 2008 work session.  Motion was made by Vice President Guns, seconded by Commissioner Tome and unanimously carried to obtain legal advice pursuant to the State Annotated Code of Maryland 10-508 (a) (1) & (7).

 

            The meeting of the Board of County Commissioners for Cecil County, March 4, 2008 was called to order by Commissioner Manlove at 7:00 p.m. and opened with the Pledge of Allegiance.

           

            The minutes from the February 5, 2008 Board of Health were unanimously approved.

 

            The minutes from the January 22, 2008 meeting of the County Commissioners were unanimously approved.

 

            -COMMISSIONERS' COMMENTS-

 

Commissioner Demmler - spoke about some of the events she had attended recently, including the 4-H Banquet and a tour of a Recycling Center.

 

Commissioner Tome - commented relating to the support of the Chamber and Cecil County residents with regard to the special legislation for the "Special Taxing District".

 

Vice President Guns - commented about several events that he has participated in, including "Read across America" and the Council of Governments meeting that took place last week.

 

President Manlove - commented about his visit to Annapolis and the "Special Taxing District" legislation.  He also commented about the 4-H Banquet.

 

Commissioner Lockhart offered no comment.

 

-          RECYCLING LOGO CONTEST AWARDS -

 

            Tanya Adams, Recycling Coordinator for Cecil County presented three Cecil County students with certificates of achievement for their efforts in the Recycling Logo Contest.

 

-          PUBLIC HEARING - CRITICAL AREA MAP AMENDMENT - REQUEST FROM ANCHOR MARINA PROPERTY - BUFFER EXEMPT AREA OF THE CHESAPEAKE BAY CRITICAL AREA PROGRAM -

 

            Thomas L. Kemp, counsel for Anchor Marina and Brad Fox, McCrone, Inc., presented to the Board a request from Anchor Marina to be exempt from the buffer requirement of the Chesapeake Bay Critical Area Program.  The property is zoned Maritime Business (MB) and is located in the Limited Development Area (LDA) of the Chesapeake Bay Critical Area. 

 

The property has been the location of an active marina prior to December 1985 with paving and impervious surface from existing building to the bulkhead at the North East River.  Currently paving or building exists within the 110-foot buffer area and this buffer area does not protect water quality or provide wildlife habitat.

 

COMMENTS SUPPORT/OPPOSITION - None.

 

Eric Sennstrom, Director of Planning & Zoning advised the Board that the Planning Commission recommended approval of the request.

 

This matter will be placed on the Commissioner's agenda at their March 18, 2008 meeting.

 

-          PUBLIC COMMENT -

 

Mike Burns, Elkton - commented in reference to the delay in voting on the Critical Area Amendment requested by the Town of Elkton.

 

Chris Diebold, North East - commented in support of "Code Home Rule".

 

Leland Corbett, North East - commented about property tax increases.

 

-          APPOINTMENTS -

 

            Motion was made by Vice President Guns, seconded by Commissioner Tome, and unanimously carried to re-appoint the following members of the Weed Control Committee for a week year term to expire 3/1/09:

-          DEPARTMENT OF PUBLIC WORKS -

 

            W. Scott Flanigan, Director, Department of Public Works, presented the following:

 

            Upon the recommendation of Mr. Flanigan, motion to approve two resolutions for the installation of stop signs on Woodrow Lane West at McCormick Drive; Woodrow Lane East at McCormick Drive; and Academy Drive East at Stratton Circle was made by Commissioner Tome, seconded by Vice President Guns and unanimously carried to approve.  A copy of these resolutions are attached hereto and made part of these minutes.

 

-          BUDGET AMENDMENT NOS.  - 72 - 77 -  

 

            Motion was made by Vice President Guns seconded by Commissioner Tome, and unanimously carried to approve Budget Amendment Nos. 72 - 77. A copy of these budget amendments are attached hereto and made part of these minutes.

 

            The next regular meeting of the Board of County Commissioners will be held on Tuesday, March 18, 2008 at 7:00 p.m. at the Chesapeake City Town Hall, Chesapeake City, MD.

 

 

 

 

There being no further business of the County Commissioners, the meeting concluded.
