MINUTES OF THE BOARD OF

COUNTY COMMISSIONERS

REZONING HEARING

February 5, 2008

 

The Board of County Commissioners of Cecil County met in regular session at the County Administration Building, 200 Chesapeake Blvd., Elkton, MD on Tuesday,
February 5, 2008.  The following members of the Board were present:

 

                        William C. Manlove, President

                        Mark H. Guns, Vice President

                        Rebecca J. Demmler, Commissioner

                        Wayne L. Tome, Sr., Commissioner  

 

                       

Constituting a majority Board.

 

The meeting was called to order by President Manlove at 2:00 p.m. and opened with the Pledge of Allegiance.

 

Alfred C. Wein, Jr., County Administrator read the application and swore in all witnesses presenting testimony.

 

File No. 2008-01 - Applicant:  Gary & Mary Sue Slagle.  Property Location:  Lot 52 Marley Farms, Childs Road, Elkton, MD.  Election District: 3, Tax Map: 20, Parcel: 316. Presently Zoned: Suburban Residential (SR). Request: To rezone approximately 1.16+/- acres from Suburban Residential, (SR) to Business General, (BG). Property Owners:  Gary & Mary Sue Slagle.

 

Gary and Mary Sue Slagle appeared before the Board and presented testimony in support of their rezoning request for Lot 52 Marley Farms.  Mrs. Slagle stated that she and her husband had purchased this property for development purposes, and as a result of the subdivision of the property, two parcels have been separated from the original plan.  These lots are now separated from the subdivision and must share a joint driveway with an entrance off of Childs Road, directly across from the existing oil refinery, and are not suitable for residential development.

 

The Slagle's have negotiated a tentative agreement with the owner of the refinery to purchase the parcel, for the location of an office for the refinery, contingent upon the property being rezoned for that purpose.  The Slagle's will then construct the office building and place any deed restrictions necessary.

 

The request to rezone Lot 52 is based upon change in the character of the neighborhood and also mistake in the 1993 Comprehensive Rezoning.

 

COMMENTS SUPPORT/OPPOSITION:  None.

 

Eric Sennstrom, Director of Planning & Zoning stated that the staff recommendation was for disapproval, based upon no demonstrated mistake or change since the 1993 Comprehensive Rezoning.

 

The Planning Commission recommended approval, based upon a change in the character of the area.

 

Clifford Houston, read the Findings of Facts.

 

Vice President Guns asked for clarification from Director Sennstrom about any other zoning that would permit this type of structure.

 

Director Sennstrom stated that Business Local (BL) would permit an office.

 

The Board inquired as to placing deed restrictions on the property.

 

Clara Campbell, County Rezoning Attorney, advised the Board that the Board cannot make recommendation with regard to deed restrictions.

 

This matter will be placed on the Board of County Commissioners Agenda for February 19, 2008.
