MINUTES OF THE BOARD OF COUNTY COMMISSIONERS
REZONING HEARING January 22, 2008
The Board of County Commissioners of Cecil County met in regular session at the County Administration Building, 107 North Street, Elkton, MD on Tuesday, January 22, 2008. The following members of the Board were present:
William C. Manlove, President Mark H. Guns, Vice President Rebecca J. Demmler, Commissioner Brian Lockhart, Commissioner Wayne L. Tome, Sr., Commissioner
Constituting a majority Board.
The meeting was called to order by President Manlove at 3:00 p.m. and opened with the Pledge of Allegiance.
Alfred C. Wein, Jr., County Administrator read the application and swore in all witnesses presenting testimony.
File No. 2007-08 - Applicant: Jay C. Emery. Property Location: 4595 Pulaski Hwy., Perryville, MD. Election District: 7, Tax Map: 30, Parcel: 42. Presently Zoned: Business Local (BL). Request: To rezone approximately 1.17 acres from Business Local, (BL) to Business General, (BG). Property Owner: George F. Porter.
Jay Emery, Esquire and George Porter, Property Owner appeared before the Board in support of a rezoning request to rezone 1.17 acres located on U.S. Route 40 in Perryville from Business Local (BL) to Business General (BG).
The applicant presented testimony that he wishes to store equipment and operate his small home improvement business from the subject location. The applicant contends that this zoning is consistent with existing zoning in the area and bases his request on mistake in the last comprehensive rezoning as well as change in the existing neighborhood.
Three photographs of the subject property were presented and entered as Applicant's Exhibits 1, 2 & 3.
COMMENTS SUPPORT/OPPOSITION: None.
Eric Sennstrom, Director of Planning & Zoning advised the Board that the Office of Planning & Zoning has recommended approval, based upon a mistake in the 1993 Comprehensive Rezoning. The Planning Commissioner has also recommended approval, based upon a mistake in the 1993 Comprehensive Rezoning.
Clifford Houston, Zoning Administrator read the Findings of Fact.
This decision will be placed on the Board's agenda for consideration at the February 5, 2008 Board of County Commissioner's meeting.
File No. 2007-09 - Applicant: Mohamed Sharkawy. Property Location: Lot 30 Telegraph Road, North East, MD. Election District: 4, Tax Map: 12, Parcel: 336. Presently Zoned: Rural Residential, (RR). Request: To rezone 1.229 acres from Rural Residential, (RR) to Business General, (BG). Property Owner: Mohamed A. Sharkawy.
Mr. Wein, read the application and swore in all witnesses presenting testimony.
Mohamed Sharkawy, Property Owner, appeared before the Board in support of a rezoning request to rezone approximately 1.229 acres, located on Telegraph Road in North East, from Rural Residential (RR) to Business General (BG).
Mr. Sharkawy presented testimony in support of his rezoning request and stated that when his family purchased the subject parcel in 1985 all the property in the area was zoned for residential purposes. The property was purchased for the purpose of building a home in the future.
As a result of the 1993 Comprehensive Rezoning the property adjacent to the applicant's property was rezoned to Business General (BG) and at the present time is in the process of being developed as a convenience store.
Mr. Sharkawy contends that as a result of this commercial development, he no longer desires to build a home at the location and would like to develop it as an office building. He is basing his request upon a mistake or change in the 1993 Comprehensive Rezoning.
COMMENTS SUPPORT/OPPOSITION:
Hammer Bereat - commented in support of the request, he and his family were the original owner's of the parcel.
Roman Grypka - 3420 Blueball Road, North East - is an adjacent property owner and spoke in opposition to the rezoning request.
Owen Thorne, 20 Hillwood Road, Elkton - commented in opposition to the rezoning request.
George Kaplan, 35 Oak Street, Colora - on behalf of the Cecil Land Use Alliance spoke in opposition to the rezoning request.
Diana Broomell, Colora - commented in opposition to the rezoning request.
Mr. Sennstrom presented the Board with the Planning Staff's recommendation, which is for disapproval, based upon no demonstrated mistake or change since the 1993 Comprehensive Plan. The Planning Commission has also recommended disapproval based upon no demonstrated mistake or change since the 1993 Comprehensive Plan.

This decision will be placed on the Board's agenda for consideration at the February 5, 2008 Board of County Commissioner's meeting.
With no further business to discuss, the meeting concluded.
